Federal documents โ such as FBI background checks, federal court orders, and documents issued by US federal agencies โ are apostilled by the US Department of State in Washington DC.
This decentralised system creates a significant practical challenge for anyone outside the US trying to get an American document apostilled. You need to know which state issued the document, whether the underlying notarisation meets that state's standards, and whether the document needs to go to the state level or the federal level. An FBI Background Check, for example, must be apostilled by the US Department of State โ not by any individual state.
